ASUU Strike: Appeal Court Begins Hearing Today.

The Abuja Court of Appeal will on Tuesday hear the appeal of the Academic Staff Union of Universities, as regards the ruling by the National Industrial Court.

 

 

This is as a result of the negotiations and discussion between the Union and the House of Representatives led by Gbajabiamila.

 

 

According to a report, Gbajabiamila-led administration was scheduled to meet with the President, Major General Muhammad Buhari.

 

The Union had on September 23, 2022 filed 14 grounds for appeal, kicking against the ruling of National Industrial Court, by Justice Hamman Polycarp that ordered the Lecturers to resume their work.

 

 

According to an application of the federal government filed through its lawyer, Mr James Igwe that directed the lecturers to resume back to work, Justice Polycarp noted that the order is in favour of Nigerian students and national interest, stating that the industrial action is detrimental to students’ health.

 

 

The Union in it’s appeal noted that Justice erred a miscarriage of justice when he was to hear and decide the respondents’ motion for an interlocutory injunction when he knew or ought to have known that the substantive suit was not initiated by due process of law..

 

 

While addressing the appellate court, ASUU said the court showed “uncontroverted and irrefutable evidence” that the Federal Government waited for about seven months before approaching the NIC for the order of interlocutory injunction.”

 

However, the union insisted that the NIC could only entertain appeals arising from the decision of the Industrial Arbitration Panel, IAP, concerning issues arising from trade disputes according to sections 17 and 18 of the TDA.

 

 

ASUU thereby noted that it was totally displeased with the decision of the trial court, which said should be stayed from execution and also set aside.
