Supreme court bars Atiku, PDP from accessing INEC’s server

The Supreme Court has dismissed the appeal of the Peoples Democratic Party and their presidential candidate to grant them access to the Independent National Electoral Commission’s sever.

A five-man panel led by Dattijo Muhammed, in a unanimous judgment, dismissed the appeal, claiming there was no basis to interfere with the past decision of the Presidential Election Petition Tribunal denying the PDP and its presidential candidate request to access INEC’s sever.

The judgment of the apex court which was read by Justice Centus Nweze, said the appellants failed to establish that the tribunal wrongfully exercised its discretion in dismissing their request.

“They failed to place sufficient materials before the apex court to show that the tribunal’s exercise of its discretion was arbitrary.

Justice Nweze holds that the allegations held by the appellants that they were denied fair hearing by the June 24, 2019 ruling of the tribunal was unsubstantiated

In the petition presented by Atiku and PDP, they alleged before the Presidential Election Petition Tribunal that the authentic results of the February 23, 2019 election which gave them victory was stored in the INCE server.

In response to the appeal made by Atiku and PDP, INEC, PMB and the All Progressive Congress urged the apex court to dismiss it as they oppose the appeal via their lawyers.

INEC was represented by Yunus Usman (SAN); Buhari was represented by Wole Olanipekun (SAN); and APC was represented by Chief Charles Edosomwon (SAN)

The meeting was however adjourned till Wednesday.
