By IPOB drags Nigeria to court
The Indigenous People of Biafra has dragged the Federal Government to court seeking for the setting aside of its proscription as a terrorist organization BlackBox Nigeria can report.
IPOB through its lawyer, Ifeanyi Ejiofor yesterday filed a motion at Federal High Court sitting in Abuja asking for the nullification of the order proscribing it as a terrorist organization.
It would be recalled that on Wednesday, September 20, the Acting Chief Judge of the Federal High Court, Justice Abdu Kafarati following the ex parte order filed by the Attorney General of the Federation and Minister of Justice, Mr. Abubakar Malami.
IPOB led by Mazi Nnamdi Kanu whose whereabouts has remained unknown since the beginning of the Operation Python Dance by the Nigerian Military is seeking for the order to be set aside and nullified while claiming that the AGF misinformed the court in his case.
“That the ex parte order was made in clear violation of the constitutionally guaranteed right of IPOB to self-determination; Article 20(1) of the African Charter on Human and Peoples Rights, now domesticated into our Law under (Ratification and Enforcement Act) (Cap 10) Laws of the Federation of Nigeria 1990; right to fair hearing, right to freedoms of expression, and the press and rights to peaceful assembly and association; clearly provided for under Sections 36, 39 and 40 of the 1999 Constitution of the Federal Republic of Nigeria as (Amended) 2011,” the IPOB prayer read in part.
