The Supreme Court has dismissed the Peoples Democratic Party’s (PDP) suit against Bola Ahmed Tinubu and Kashim Shettima, the presidential and vice-presidential candidates of the All Progressives Congress (APC).
The court ruled on May 26, 2023, stating that the PDP and its presidential candidate had no legal standing to bring the suit.
The court panel, consisting of five members, determined that the PDP, being a different political party, lacked the authority to challenge the candidacy of Tinubu and Shettima within the APC.
The PDP had argued that Shettima’s nomination as Tinubu’s running mate violated various provisions of the Electoral Act of 2022, including sections 29(1), 33, 35, and 84(1)(2).
Justice Adamu Jauro, while delivering the judgment, characterized the PDP as an interfering outsider and a busybody, emphasizing that the matter was an internal affair of the APC.
Furthermore, the court ordered the PDP to pay a penalty of Two Million Naira, and the suit was dismissed due to its lack of merit.
