The Supreme court has upheld the victory of Sen.Tokunbo Abiru representing Lagos East Senatorial District.
The Judgment was delivered by Justice Adamu Jauro who wrote the lead judgement, Wednesday.
The court in the judgement adopted the issues formulated for determination by the Appellant.
In resolving the first issue against the Appellant, the court held that the failure of the Appellant to disclose the date of publication before the trial court is fatal to their case as that fact is material to the determination of the case.
As a result, the court held that the case at the trial court is not competent and consequently dismissed same. Based on the resolution of issue one against the Appellant, The Appeal was thus held to be lacking in merit and same was therefore dismissed.
A Cost of ₦1million was awarded against the Appellants and in favour of each of the Respondents.
Having dismissed the Appeal, the Court held that there was no reason to dabble into the cross appeal. As a result, the cross appeals were dismissed.
The other four Justices concurred with the lead judgement.
