Court Rejects Tosin Onomade’s Application To Join IGP In Fundamental Human Right Case, As He Seeks Freedom of Movement
The Ikorodu High Court under his Lordship, Justice A.F. Pokanu of Court Two sitting in Ikorodu, on Friday, January 21, 2022, denied the application to join the Inspector General of Police (IGP), Usman Alkali Baba, in a fundamental human rights matter brought before the court by Mr Oluwatosin Onamade.
The trial judge, in his ruling, positioned that the application cannot join the IGP and others in a suit bothering on an arrest independent of the matter before it and that the IGP and others are not necessary to the determination of the matter.
Mr Oluwatosin Onamade the owner of Western Funeral Home Limited, Ijede had on July 12, 2021, filed a case with Suit No: IKD/11531/MRHR/21, wherein he sought for the enforcement of his Fundamental Rights to dignity of Human Person, Personal Liberty, Freedom of Movement and Right to Property.
In the Affidavit of Urgency, Oluwatosin Onamade had filed the application against the Deputy Inspector General of Police (Force Intelligence Bureau, Area 10, Garki, Abuja), DCP Eloho Okpoziakpo (Force Intelligence Bureau, Area 10, Garki, Abuja), ASP Abubakar Inwanfero (I.P.O), Force Intelligence Bureau, Area 10, Garki, Abuja) and Fathiu Jimoh Salisu, seeking to assert his fundamental human right and protection from arrest.
In an affidavit obtained by BlackBox Nigeria, Onomade deposed to seven grounds herein as follows:
“That, I am the Applicant herein and by virtue of this position, I am conversant with the facts thereof.
“That, the Respondents have recently spread their net for the search and immediate arrest and detention of me.
“That, the said arrest was maliciously instigated by 4th Respondent who made false allegation against me to 1st – 3rd Respondents.
“That, subsequently, I have gone into hiding because the 3rd Respondent is incessantly harassing and intimidating me.
“That, unless this application is heard urgently, the Respondents will not stop to violate my fundamental human rights.
“That, the interest of justice is for this application to be heard urgently, and
“That, I depose to this affidavit in good faith conscientiously, believing its content to be true and correct and in accordance with the oath laws of Lagos State 2003”, the affidavit reads.
It will be recalled that BlackBox Nigeria earlier reported the suing of Onomade by the IGP over false allegations of murder. In the suit with reference number FHC/1/320C/2021 before Hon. Justice A.O. Faji (Court 2) at Federal High Court in Ikoyi, Lagos, the Inspector General of Police accused Onamade of intentionally circulating grossly offensive propaganda to cause insult upon Fatiu Salisu, who at the time was the Chairman of Ijede LCDA.
Consequent to this false accusation and the quest of the IGP to ensure Onomade faces the law, he (Onomade) instituted a counter case in Ikorodu to dissuade the IGP from arresting him and also add the IGP to the case in Ikorodu.
The matter in Ikorodu High Court was adjourned till February 7, 2022, to commence hearing.
